A personal injury claim arises when an individual has suffered some type of loss as a result of another's negligent actions.

"Negligence" means that the person who caused the loss failed to act with reasonable care. For example, if you were injured in a car accident because the other driver was texting while driving, the other driver could be held liable for your injuries because she did not act with reasonable care by driving while distracted.

All personal injury cases in Ireland must be submitted to the PIAB (Personal Injuries Assessment Board). The PIAB is an independent statutory board that assesses the value of personal injury claims in Ireland.

There are strict time limits for making a personal injury claim in Ireland. All cases must be commenced within two years from the date of the accident in line with the statute of limitation.

Following an evaluation of all available medical evidence, the PIAB will put forward their valuation on what they feel the claim is worth. The case can then be settled by way of compensation if all parties are happy with the assessment.
